Recently, the U.S. District Court for the Northern District of California ruled that the technology company OpenAI won the trademark dispute related to "OpenAI" (including spaces). The court revoked the trademark registration of another company, Open Artificial Intelligence Inc. (OAI), for the name and prohibited it from continuing to use the related logo. The rights dispute over the "open.ai" domain name has finally come to an end.
OAI acquired the "open.ai" domain name in 2015 and submitted an application for the "OpenAI" trademark the day after OpenAI was established. However, the court determined that it did not actually conduct business, the website content lacked evidence of real use, and even forged materials to mislead the Trademark Office, and was ultimately determined to be a malicious registration.

From the perspective of domain name investment, this case once again shows that registering a good domain name does not mean mastering the brand voice. For a domain name to have real value, it must be accompanied by actual use and the establishment of market awareness. If you only hold a domain name but do not form a specific brand application, it is often difficult to resist subsequent legal challenges.
The court also specifically pointed out in its ruling that the name "OpenAI" has acquired a "secondary meaning", which means that it has a clear brand recognition function in the minds of the public. This is also a key factor that domain name holders tend to overlook - when a name has formed a strong association with a specific entity, even if the domain name is registered first, it may lose the case due to confusion risk or brand priority use rights.
The early "registration means possession" logic of the domain name industry is being gradually revised by the real market and legal precedents. Today, high-quality domain names alone cannot build a stable asset barrier. What can really enhance the value of a domain name is the brand power, continuous operation and legal and compliant use path associated with it.
