The case was filed by NewsCatcher, Inc., a provider of news data services. The company has been operating under the "NewsCatcher" brand since 2020 and obtained trademark registration in June 2025. The complainant argued that the domain name newscatcher.com is identical to its brand name and is used in the same industry, potentially misleading users into believing there is a connection between the two companies, and therefore requested the domain name be transferred to its own name.

The respondent was Perigon, Inc. and its affiliates. Perigon legally acquired newscatcher.com from a third party in 2022 and configured it to redirect to its official website. Both companies operate in the news data retrieval and structured information services sector and are direct competitors in the open market. The complainant argued that the respondent acquired the domain name knowing of its brand's existence, constituting "goodwill exploitation."
During the arbitration proceedings, it was confirmed that newscatcher.com was originally registered in 1999, predating the complainant's brand. The current holder also acquired the domain name earlier than the complainant obtained trademark registration. Furthermore, while the complainant stated that "NewsCatcher" had been used as a brand for many years, it failed to provide sufficient evidence to prove that the name had achieved distinctiveness or a recognizable brand identity in the relevant market.
Regarding malicious use, the arbitral tribunal pointed out that the respondent's 301 redirect of the domain name did not constitute misleading, and there was no false advertising, phishing, or attempt to sell the domain. The case was a commercial dispute between competing companies, not a typical case of malicious registration.
Ultimately, the arbitral tribunal held that the complainant failed to meet the three necessary requirements stipulated in the UDRP, and the complaint was unfounded. The ruling was: the complaint is dismissed, and the domain name newscatcher.com will not be transferred.
