Alexandria, VA, June 28, 2024 - Leading yoga apparel company Alo,LLC is filing a lawsuit in the U.S. District Court for the Eastern District of Virginia alleging that the owner of the domain name ALO.com is using its trademark in bad faith.

Alexandria, VA, June 28, 2024 - Leading yoga apparel company Alo,LLC is filing a lawsuit in the U.S. District Court for the Eastern District of Virginia alleging that the owner of the domain name ALO.com is using its trademark in bad faith.Through this legal action, Alo,LLC is attempting to obtain ownership of the ALO. com domain name.

The CEO of Alo,LLC stated that the company attempted to file a reverse domain name hijacking lawsuit against ALO.com in 2017 through the Uniform Domain Name Dispute Resolution Policy (UDRP), however, it ultimately lost the case.The UDRP panel determined that the lawsuit was in bad faith because the registration of the ALO.com domain name pre-dated the founding of Alo,LLC.

Nonetheless, Alo, LLC filed another lawsuit this week, claiming that the current use and registration of the defendant's domain name makes this action necessary. The company contends that ALO.com's recent bad faith use of its trademarks, specifically the domain name being parked on advertisements related to Alo and its competitors, constitutes an infringement of intellectual property rights.

In its lawsuit filing, the company states, "In this lawsuit, Alo does not allege that the Defendant Domain Names were registered to take advantage of Alo's trademarks when they were initially created, and that Alo did not realize that the Defendant Domain Names were being used to infringe on Alo's intellectual property rights until recently."

David Weslow, a legal representative for Alo, LLC, said that the registrant of the domain name appeared to be the same registrant that the same person had filed a UDRP lawsuit against in 2017, even though Whois records showed that the domain name had recently been re-registered.

The clothing company ultimately lost the lawsuit, which the panel found to be in bad faith because the domain name was registered before the clothing company was founded.
