Neurocog Pty Ltd, an Australian clinical psychology clinic, has filed a UDRP against the domain name Neurocog.com. The company has registered the trademark "Neurocog" in both Australia and the United States.

According to the WIPO panelists, the domain name is identical to the Complainant's mark, but the Respondent has failed to demonstrate that it has any rights or legitimate interests in the domain name. However, the Panel also found that since the domain name was registered five years before the Complainant obtained the trademark rights, the Complainant failed to prove that the domain name was registered and used in bad faith.

Final Decision: The transfer of Nerurocog.com to the Complainant is denied; furthermore, the Panelists determined that the Complaint was filed in bad faith and constitutes an attempt at reverse domain name hijacking.

Pursuant to the Administrative Panel's decision, the Complaint was assigned case number D2024-1076.The Complainant is represented by LegalVision ILP Pty Ltd of Australia and the Respondent is the Domain Administrator of CentralNic Ltd of the United Kingdom.

The Complainant alleges that the Respondent has failed to demonstrate any rights or legitimate interests in the disputed domain name, and the Panel found that the Complainant had failed to demonstrate bad faith registration and use of the domain name. Ultimately, the Panel found that the complaint was filed in bad faith and constituted an attempt at reverse domain name hijacking.

This decision is significant for the future of domain name dispute resolution and highlights the importance the Panel places on protecting the rights of legitimate domain name holders.
